Question about VA services and workers comp. My insured just got hit with additional premium on their workers comp audit for using a VA service. When my insured asked for a COI, they told my insured that they did not carry workers comp since their employees were citizens of the Phillipines and not subject to US labor laws. Has anyone had any experience with this?

Usually foreign workers are not paid as “employees” and are instead paid as vendors, and won’t be subject to charges as employees or employment taxes - or treated as sub contractors.

Not this situation exactly but depending on the work comp law in your state, anyone hired to do work in that state is likely eligible for work comp benefits and therefore the audit would stand. Even illegals get work comp benefits in our state if injured. Not wage loss, because they are not legally eligible to work, but paid medical for injuries.
